According to the constitution of Kenya 2010, Public input on matters legislation, at a national level and a county level is a MUST. Contrary passage of any legislation and law is Null and Void and UNCONSTITUTIONAL.

Chapter one of the a Constitution sacredly gives powers to The People of Kenya. Chapter 1 (1) states that All sovereign power belongs to the people of Kenya and shall be exercised only in accordance with this Constitution.
Any matters done by the delegated leaders should be consistent with the People.

Chapter 11 article 196 sub article 1 (a,b,c) and 2 states that;
(1) A county assembly shall
(a)conduct its business in an open manner, and hold its sittings
and those of its committees, in public; and
(b)facilitate public participation and involvement in the
legislative and other business of the assembly and its
committees.

(2) A county assembly may not exclude the public, or any media,
from any sitting unless in exceptional circumstances the speaker has
determined that there are justifiable reasons for doing so.

We can Conclusively say that, the matter in which The Finance Bill 2015 for the County Government of Kilifi was passed, was UNCONSTITUTIONAL. There was no public nor stakeholders in put before it was hurriedly passed by the County assembly as bribery allegations suffices that Some MCA’S were bribed to passed this piece of ‘Draconian’ law.

Malindi small scale traders, business operators shut down their businesses on 23/3/2015 to protest the doubling of the tax fees. Malindi Town, was a center of street battles with the anti riot police. Tear gass was thrown right left and center. Malindi was ungovernable as ALL businesses was shut down.
iT IS YET TO BE SEEN IF GOVERNOR HON. AMASON KINGI AND THE MCA’S WILL HEED THE CRIES OF THE TRADERS WHO ARE POOR AND CANNOT AFFORD TO SUSTAIN THE HIKED TAX FEES.
